My dictionary (Iosephus Esmond Riddle et Thomas Kerchever Arnold, A Copious and Critical English-Latin Lexicon (1849-1872) (Textus apud Google Books)) suggests poena vitae or poena capitis for the concept, supplicium capitis or extremum/ultimum supplicium for the (as it were) execution. I like the adjective better than the noun, and so does my buddy Sallust:

Latin vocab may be deficient on many counts, but it is certainly not lacking in expressions for rendering 'Capital punishment'. Poena vitae, capitis, mortis, capitalis as well as Supplicium capitis, capitale, ultimum, extremum, summum are all perfectly classical. As Andrew Dalby says, the difference between poena and supplicium is approximately that of imposition and execution. The Institutiones use both poena capitis and capitalis (although the most common term there is the bare supplicium). I have a slight preference for poena capitis as a title, but that is mere taste.--Ceylon 11:47, 13 Aprilis 2008 (UTC)Reply
