Poena capitis (per discussion below)

Hmm... supplicium with some sort of distinguishing adjective maybe? --Iustinus 07:29, 22 Martii 2008 (UTC)

My dictionary (Iosephus Esmond Riddle et Thomas Kerchever Arnold, A Copious and Critical English-Latin Lexicon (1849-1872) (Textus apud Google Books)) suggests poena vitae or poena capitis for the concept, supplicium capitis or extremum/ultimum supplicium for the (as it were) execution. We could start with poena vitae. Andrew Dalby (disputatio) 10:01, 22 Martii 2008 (UTC)
I like the adjective better than the noun, and so does my buddy Sallust:
[36]Sed ipse paucos dies conmoratus apud C. Flaminium in agro Arretino, dum vicinitatem antea sollicitatam armis exornat, cum fascibus atque aliis imperi insignibus in castra ad Manlium contendit. Haec ubi Romae comperta sunt, senatus Catilinam et Manlium hostis iudicat, ceterae multitudini diem statuit, ante quam sine fraude liceret ab armis discedere praeter rerum capitalium condemnatis. Praeterea decernit, uti consules dilectum habeant, Antonius cum exercitu Catilinam persequi maturet, Cicero urbi praesidio sit.

Latin vocab may be deficient on many counts, but it is certainly not lacking in expressions for rendering 'Capital punishment'. Poena vitae, capitis, mortis, capitalis as well as Supplicium capitis, capitale, ultimum, extremum, summum are all perfectly classical. As Andrew Dalby says, the difference between poena and supplicium is approximately that of imposition and execution. The Institutiones use both poena capitis and capitalis (although the most common term there is the bare supplicium). I have a slight preference for poena capitis as a title, but that is mere taste.--Ceylon 11:47, 13 Aprilis 2008 (UTC)
